Goodix Technology Co., Ltd. (collectively, "Goodix", "we", "us", and "our") respects your privacy. We treat your personal data in strict confidence and in compliance with data protection law, including – if applicable – the General Data Protection Regulation ("GDPR"). Please read the following to learn more about our Privacy Policy ("this Policy"). This Policy applies to Goodix websites, products, and services that display or provide links to this Policy.

If not expressly indicated otherwise in the specific Section of this Policy (see Section 4. and 5.), this Policy shall also apply to residents of and customers from the European Economic Area (“EEA”). Residents of and customers from the EEA, however, may find additional information on the processing of their personal data, including the relevant legal bases and their rights regarding the processing, in Section 9. of this Policy.  

This Policy describes how Goodix processes your personal data, but it may not address all possible data processing scenarios. Goodix may inform you of product- or service-specific data collection through supplementary policies or notices provided before collection.

1. Definitions 

Personal data means any information relating to a natural person (the data subject) who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or an online identifier.

Processing means any operation which is performed on personal data, such as collection, recording, organization, structuring, storage, adaptation or any kind of disclosure or other use. 

2. How We Process Your Personal Data

In the following, we describe how we process your personal data. 

2.1 Informational Use of the Website

When you visit our website for informational reasons and without providing us with personal data in any other form, we may automatically collect additional information about you which will contain personal data only in limited cases and which is automatically recognized by our server, such as: computer/network information (IP address; device type, name and IDs; date and time of the requests; information on the browser version; screen resolution; information on the operating system, including language settings)

We use such information only to assist us in providing an effective service (e.g. to adapt our website to the needs of your end user device or to allow you to log in to our website), and to collect broad demographic information for anonymized, aggregate use. 

2.2 Registration for our Products and Services 

You can set up an account on our website in order to use additional products and services. With regard to the registration of an account and its subsequent use, we process: Information (such as user name and email address, password) that is provided by registration and information in connection with an account sign-in facility (e.g. log-in and password details).

The information which is necessary for the performance of the product or service is labelled accordingly. All further information is provided voluntarily.

We will process the personal data you provide to identify you at sign-in, provide you with the products, services and information offered through the website and administer your account. 

2.3 Provision and Improvement of our Products and Services 

In addition, we may use your personal data for the following purposes in the context of the provision of our products and services:

• Sending you important notices;

• Qualifying and managing suppliers and business partners, and communicating or working with suppliers and business partners;

• Improving our products and services through internal audits, data analysis, and research;

• Troubleshooting when you send us error reports;

• Synchronizing, sharing, and storing the data you upload or download and the data needed for the uploading and downloading;

• Ensuring the security of our products, services and customers or users, executing and improving our loss prevention and anti-fraud programs;

• Complying with and enforcing applicable legal requirements, industry standards and our policies.

2.4 Collection and use of non-personal data

Goodix may also collect and use non-personal data. Non-personal data is information that cannot be used to identify a particular individual. For example, Goodix will collect statistical data, such as the numbers of visits to its website. We collect this data to understand how users use our websites, products, and services so that we can improve our services and better satisfy your needs. Goodix may collect, use, process, transfer, or disclose non-personal data for other purposes at its own discretion.

We will isolate your personal data from non-personal data and ensure that the two types of data are used separately. If personal data is combined with non-personal data, it will still be treated as personal data during processing.

2.5 Legal basis for the data processing

Goodix will process your personal data following the requirements of applicable laws on an appropriate legal basis, including:

• Processing your personal data to fulfil the contract when responding to a transaction or service request;

• Processing your personal data with your consent;

• Processing based on the legitimate interests of Goodix or a third party when we use your personal data to contact you, conduct marketing or market surveys, improve our products and services, execute and improve our loss prevention and anti-fraud programs, and other purposes. Legitimate interests include enabling us to more effectively manage and operate our business and provide our products and services; protecting the security of our businesses, systems, products, services, and customers; internal management; complying with internal policies and processes; and other legitimate interests described in this policy;

• Processing your personal data as necessary to comply with and fulfil legal obligations.

3. Cookies 

When you visit our websites or in general our digital platforms, cookies might be stored on your devices within the web browser. Cookies are small text files that can store information for a certain period and identify your device. We use cookies to optimize your user experience on our websites.

We will not use cookies for any purposes not stated in this Policy. You can manage or delete cookies based on your own preferences. You can clear all the cookies stored on your computer, and most web browsers provide the option of blocking cookies. 

4. How We Disclose Personal Data

Goodix shares your personal data with other partners, as described in this Policy, when services are provided by partners authorized by Goodix. In addition, as a global company, we may share personal data with Goodix affiliates and subsidiaries.

To comply with applicable laws or respond to valid legal procedures, Goodix may also disclose your personal data to law enforcement or other government agencies. 

If Goodix is involved in a restructuring, merger & acquisition, or a bankruptcy or liquidation lawsuit in a given jurisdiction, your personal data may be disclosed in connection with the transaction. 

Goodix may also disclose your data when appropriate, for example, to execute Terms and Conditions, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or when it is in connection with an investigation of suspected or actual illegal activity.

This Section 4. does not apply with regard to residents of and customers from the EEA. Please find information regarding the disclosure of their personal data in Section 9.3 of this Policy.

5. How to Access & Control Your Personal Data

Goodix is dedicated to maintaining the accuracy and completeness of personal data and keeping the data up-to-date.

To the extent required by applicable law, you may (i) have the right to access certain personal data we maintain about you, (ii) request that we update or correct inaccuracies in that data, (iii) object or restrict to our use of your personal data, and (iv) ask us to delete your personal data from our database. To exercise these rights, please give your feedback to us. Your written request may be required for security. We may decline the request if we have reasonable grounds to believe that the request is a fraudulent, unfeasible or may jeopardize the privacy of others.

If allowed by applicable laws, you have the right to withdraw your consent at any time when Goodix processes your personal data based on your consent. However, withdrawal does not affect the legitimacy and effectiveness of how we process your personal data based on your consent before the withdrawal is made; nor does it affect any data processing based on another justification other than your consent.

This Section 5. does not apply with regard to residents of and customers from the EEA. Please find information on their rights regarding the processing in Section 9.4 of this Policy.

6. How We Protect and Retain Your Personal Data

6.1 Security

The security of your personal data is important to us. We use appropriate physical, management, and technical measures to protect your personal data from unauthorized access, disclosure, use, modification, damage, or loss. For example, we use cryptographic technologies for data confidentiality, protection mechanisms to prevent attacks, and access control mechanisms to permit only authorized access to your personal data. We also provide training on security and privacy protection for employees to raise their awareness of personal data protection. Goodix is committed to protecting your personal data; however, please note that no security measure is perfect.

6.2 Data Retention

We will retain your personal information for no longer than is necessary for the purposes stated in this Policy, unless otherwise extending the retention period is required or permitted by law. The specific data storage period may vary with scenario, product, and service. 

We will maintain your registration information as long as your account is necessary for service provision. You can choose to deregister your account. After you deregister your account, we will stop providing you with products and services through your account and – subject to statutory retention requirements – delete your relevant personal data.

7. How We Process Children's Personal Data

Our websites, products and services are primarily intended for adults. A child must not create a Goodix account without the consent of a parent or guardian. If a child's personal data is collected with prior parental consent, we will only use or disclose the data as permitted by law, with the explicit consent of the child's parents or guardians, or when necessary for the protection of the child. If we accidentally collect a child's personal data without verified prior consent from the child's parents, we will attempt to delete the data as soon as possible.

8. Third-Party Providers and Their Services

To ensure a positive user experience, you may receive content or web links from third parties other than Goodix, its partners and/or its contractors. Goodix does not have the right to control such third parties, but you can choose whether to use the links, view the content and/or access the products or services provided by third parties.

Goodix cannot control the privacy practices and data protection policies of third parties that are not subject to this Policy. When you submit personal information to such a third party, please read and refer to the privacy protection policy of the third party.

9. Information for EEA residents and customers 

This Section 9. only applies with regard to the processing of personal data of residents of and customers from the EEA and provides specific information in the light of the GDPR.

9.2 Legal Basis for the Data Processing

In the following, we provide information on the legal basis for the processing of personal data described in Section 2. and 3. of this Policy. 

9.2.1 Informational Use of the Website

The personal data automatically collected during the informational use of the website is necessary for us to provide the website, Article 6 para. 1 sent. 1 lit. b GDPR (performance of a contract), and for our legitimate interest to guarantee the website’s stability and security, Article 6 para. 1 sent. 1 lit. f GDPR (data processing for the purposes of a legitimate interest).

Personal data that is collected automatically is retained for a week and properly erased afterwards.

9.2.2 Registration for our Products and Services 

The legal basis for the data processing in the context of the registration for our products and services is Article 6 para. 1 sent. 1 lit. b GDPR (performance of a contract).

Personal data that is collected from your Goodix account is retained in our sever until your account is canceled.

With regard to the retention period of the personal data, please see Section 6.2.

9.2.3 Provision and Improvement of our Products and Services 

We process your personal data based on the following legal basis in the context of the provision and improvement of our products and services:

•The data processing for the following purposes is based on Article 6 para. 1 sent. 1 lit. b GDPR (performance of a contract) in the context of the provision of our products and services: 

Sending you important notices;

• Moreover, we process your personal data on the legal basis of Article 6 para. 1 sent. 1 lit. f GDPR (data processing for the purposes of a legitimate interest) for the following purposes: 

Improving our products and services through internal audits, data analysis, and research;

Ensuring the security of our products, services and customers or users, executing and improving our loss prevention and anti-fraud programs.

We have a legitimate interest in improving our products and services. We also have a legitimate interest in ensuring their security and executing and improving our loss prevention and anti-fraud programs.

• We also process your personal data in order to comply with and enforce applicable legal requirements, industry standards and our policies on the legal basis of Article 6 para. 1 sent. 1 lit. c (data processing for compliance with a legal obligation) and f GDPR (data processing for the purposes of a legitimate interest). We have a legitimate interest in complying and enforcing the foregoing requirements, standards and policies.

With regard to the retention period of the personal data, please see Section 6.2.

9.2.4 Cookies

Cookies, which are necessary for carrying out electronic communications or for providing specific functions requested by you, are stored based on and in compliance with Article 6 para. 1 sent. 1 lit. f GDPR (data processing for the purposes of a legitimate interest). We have a legitimate interest in storing cookies so as to ensure technically flawless and optimized provision of its services.

9.3 How We Disclose Personal Data

In addition, as a global company, we may share personal data with Goodix affiliates and subsidiaries. The legal basis for sharing your information with Goodix affiliates and subsidiaries is Art. 6 para. 1 sent. 1 (f) GDPR (data processing for the purposes of a legitimate interest). We have a legitimate interest in sharing your information for internal administrative purposes, in particular to deal with any inquiries in an efficient and high-quality manner

To comply with applicable laws or respond to valid legal procedures, Goodix may also disclose your personal data to law enforcement or other government agencies. 

If Goodix is involved in a restructuring, merger & acquisition, or a bankruptcy or liquidation lawsuit in a given jurisdiction, your personal data may be disclosed in connection with the transaction. 

Goodix may also disclose your data when appropriate, for example, to execute Terms and Conditions, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or when it is in connection with an investigation of suspected or actual illegal activity.

Within the scope of our information sharing activities set out above, your personal data may be transferred to other countries (including countries outside the European Economic Area) which may have different data protection standards than your country of residence. Please note that data processed in a foreign country may be subject to foreign laws and accessible to foreign governments, courts, law enforcement, and regulatory agencies. However, we will endeavor to take reasonable measures to keep up an adequate level of data protection also when sharing your personal data with such countries.

9.4 Your rights as a Data Subject

Under applicable law, you may be entitled to exercise some or all of the following rights:

The right to

• require (i) information whether your personal data is retained and (ii) access to and/or duplicates of your personal data retained, including the purposes of the processing, the categories of personal data concerned, and the data recipients as well as potential retention periods; 

• request rectification, removal or restriction of your personal data, e.g. because (i) it is incomplete or inaccurate, (ii) it is no longer needed for the purposes for which it was collected, or (iii) the consent on which the processing was based has been withdrawn;

• refuse to provide and – without impact to data processing activities that have taken place before such withdrawal – withdraw your consent to processing of your personal data at any time;

• object, on grounds relating to your particular situation, to processing of your personal data, in case such processing is either based on our or a third party’s legitimate interests or on a performance of a task carried out in the public interest. In this case, please provide us with information about your particular situation. After the assessment of the facts presented by you we will either stop processing your personal data or present you our compelling legitimate grounds for an ongoing processing;

• object to processing of your personal data for direct marketing at any time;

• take legal actions in relation to any potential breach of your rights regarding the processing of your Personal data, as well as to lodge complaints before the competent data protection authorities; and/or

• require (i) to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and (ii) to transmit those data to another controller without hindrance from our side; where technically feasible you shall have the right to have the personal data transmitted directly from us to another controller.

Any communication and any actions taken by us regarding the abovementioned rights is provided free of charge. However, where requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may either (i) charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested or (ii) refuse to act on the request.

If we have reasonable doubts concerning the identity of the natural person making the request, we may request the provision of additional information necessary to confirm the identity of the data subject.

9.5 Automated Decision Making

We do not use your personal data for automated decision making which produces legal effects concerning you or similarly significantly affects you. 

10. Updates to This Policy

Goodix reserves the right to update or change this Policy at any time. We will release the latest Privacy Policy on this page for any changes. If major changes are made to the Privacy Policy, we may notify you through different channels, for example, posting a notice on our website or sending you direct notification.
